APANY Donation
and Refund Policy

Clear guidance on charitable donations, donor designations,
payment processing, event payments, and refund requests.

Last updated: August 7, 2026

The Anguilla Progressive Association of New York, Inc. (“APANY,” “we,”
“our,” or “us”) is a nonprofit organization recognized under Section
501(c)(3) of the Internal Revenue Code. APANY is committed to responsible
stewardship, transparency, and respect for donor intent.

This policy applies to donations made directly to APANY through its
website, approved payment platforms, checks, bank transfers, fundraising
campaigns, and other authorized methods.

Donations to APANY

A donation is a voluntary charitable gift made without the expectation
of receiving goods, services, repayment, ownership, or financial
benefit. Unless otherwise stated, donations made directly to APANY
support APANY’s charitable mission, programs, operations, and community
initiatives. APANY’s Employer Identification Number is
11-3329205.

General Donations

General or unrestricted donations may be used where APANY determines
the need is greatest, consistent with its charitable mission and
applicable law.

  • Education and scholarship programs
  • Youth and senior initiatives
  • Cultural and heritage preservation
  • Disaster preparedness and relief
  • Community development
  • Diaspora engagement
  • Approved charitable partnerships
  • Reasonable administrative and program expenses

Designated and Restricted Donations

Donors may sometimes indicate a preferred APANY campaign, project,
program, or charitable purpose. Unless APANY separately accepts a
legally binding restriction in writing, a donor’s designation will be
treated as a charitable preference rather than a condition requiring
APANY to transfer funds to a particular organization or person.

APANY will make reasonable efforts to honor a donor’s stated preference.
However, APANY retains final control and discretion over donations made
to APANY to ensure that funds are used for legitimate charitable
purposes, consistently with APANY’s mission, in compliance with
applicable law, and in accordance with APANY’s governance and
financial-control procedures.

If a designated project becomes fully funded, completed, delayed,
impracticable, inconsistent with APANY’s mission, or legally
impermissible, APANY may contact the donor when practical to discuss
another eligible purpose. If the donor cannot be contacted, APANY may
use the funds for a substantially similar charitable purpose, subject
to any legally enforceable restriction and applicable law.

Donations for Individuals

APANY does not accept tax-deductible donations earmarked for a
specifically named individual or family unless the assistance is
administered through an APANY-approved charitable program using
objective eligibility and selection criteria.

Donors may recommend a general cause or program, but they may not
control the selection of a particular charitable beneficiary. The
Internal Revenue Service generally does not treat gifts earmarked for
a specific individual as deductible charitable contributions.

Donations Connected to Outside Organizations

APANY may collaborate with or support independent charitable
organizations, community groups, schools, or programs. A donation made
to APANY for an APANY-administered charitable initiative remains under
APANY’s exclusive legal control and discretion. APANY may use the funds
directly or provide an approved grant or other assistance after
appropriate review.

A donation made directly to an outside organization through that
organization’s website or payment system is not a donation to APANY.
Such donations are governed by the outside organization’s policies.
Donors should review APANY’s
Partner and Third-Party Donation Disclosure
before donating through an external link.

Event Tickets, Membership Fees and Sponsorship Payments

Payments for event tickets, advertisements, membership benefits,
sponsorship packages, merchandise, or other goods and services may not
qualify entirely as charitable donations.

When a payment exceeds $75 and the payer receives goods or services in
return, APANY will provide the required disclosure, including a
good-faith estimate of the value of the benefits received. Generally,
only the amount paid above that value may be deductible.

Event cancellations, ticket transfers, sponsorship withdrawals, and
membership payments may be subject to separate terms published for the
applicable event or program.

Tax Acknowledgments

APANY will provide an acknowledgment or receipt for donations when
required or reasonably requested. Donors who contribute $250 or more
should retain a written acknowledgment from APANY for their tax
records.

APANY does not provide individual tax, legal, or financial advice.
Donors should consult a qualified adviser concerning the deductibility
of a particular payment.

Refund Policy

Important: Charitable donations are generally final
and nonrefundable. A change in the donor’s financial circumstances or
decision, by itself, does not guarantee a refund.

APANY may consider a refund in the circumstances listed below:

  • The same donation was processed more than once.
  • The incorrect amount was entered.
  • The donation resulted from a documented technical error.
  • The payment was unauthorized or fraudulent.
  • APANY cannot legally or practically use the donation for an accepted
    restricted purpose.
  • A refund is otherwise required by law.

Requesting a Refund

Refund requests should be submitted within 30 calendar days of the
donation. The request must include:

  • Donor’s full name
  • Email address
  • Donation date and amount
  • Payment method
  • Transaction or receipt number
  • Reason for the request
  • Supporting information

Refund Review and Processing

APANY will review the request and may ask for additional information to
verify the payment. Approval is not automatic.

APANY may deny a request when:

  • The donation has already been committed or used.
  • The request cannot be verified.
  • The request falls outside the stated period.
  • A third party processed and received the donation.
  • A refund would violate an accepted restriction, agreement,
    payment-platform rule, or applicable law.

Approved refunds will generally be returned to the original payment
method. Processing time depends on the payment provider and financial
institution.

APANY will not issue cash or send a refund to a different person,
account, or payment method except when legally required and properly
verified.

Processing Fees

Payment processors may charge transaction fees. Whether those fees can
be returned depends on the processor’s rules. APANY will disclose any
nonrefundable fee that materially affects an approved refund, to the
extent permitted by law and the applicable payment agreement.

Chargebacks and Unauthorized Transactions

Donors should contact APANY before initiating a payment dispute when
practical so that APANY has an opportunity to investigate. Suspected
fraud or an unauthorized transaction should also be reported promptly
to the donor’s bank, credit-card company, or payment provider.

Recurring Donations

Donors may cancel future recurring donations at any time by using the
cancellation tools provided by the payment platform or by contacting
APANY. Cancellation stops future charges but does not automatically
refund donations already processed.

Please allow sufficient time before the next scheduled payment for a
cancellation request to be processed.

Policy Changes

APANY may revise this policy to reflect changes in its programs,
payment methods, operations, or legal obligations. The revised policy
will be posted on APANY’s website with an updated effective date. The
policy in effect on the date of a donation will generally govern that
transaction.
