Partner and Third-Party
Donation Disclosure
Understand the difference between donations made to APANY and
contributions made directly to independent partner organizations.
Last updated: August 2026
Anguilla Progressive Association of New York, Inc. (“APANY,” “we,”
“our,” or “us”) works with and provides information about independent organizations, schools, community groups, programs, and charitable initiatives in Anguilla and elsewhere.
This disclosure explains the difference between a donation made directly to APANY, a donation to an APANY-administered project that may benefit a partner, and a donation made directly to an independent third party.
Donors should understand this distinction before completing a transaction.
Independent Organizations
Organizations described or linked on APANY’s website may be legally and
financially independent from APANY. Unless expressly stated otherwise, APANY does not:
- Own or control the outside organization.
- Manage its directors, officers, employees, or volunteers.
- Control its bank accounts or payment systems.
- Prepare its financial statements or tax filings.
- Guarantee its programs, services, representations, or use of a direct donation.
- Act as its fiscal sponsor or fundraising agent.
- Accept legal responsibility for its conduct.
The presence of an organization’s name, logo, description, or website
link on APANY’s website does not by itself create an agency, joint
venture, legal partnership, sponsorship, endorsement, or fiduciary relationship.
Donations Made Directly to APANY
A donation is made to APANY when APANY is clearly identified as the
recipient, the payment is processed through an APANY-controlled account, the donor receives an acknowledgment from APANY, and APANY retains legal control and discretion over the funds.
APANY may consider a donor’s preference for a particular project or
partner, but APANY must retain final authority over how funds are used
unless it has expressly accepted a legally enforceable restriction.
APANY will not serve as a mere conduit for donations automatically
earmarked for a particular individual or outside organization.
APANY-Administered Partner Programs
APANY may approve a charitable initiative that benefits or involves an
outside organization. APANY retains control over donations it receives
and determines whether and how funds may be used for the approved
charitable initiative.
Funds are not automatically payable to an organization merely because a
donor selected or mentioned that organization. APANY may:
- Operate the activity directly.
- Purchase approved goods or services.
- Reimburse verified charitable expenses.
- Enter into a written partnership or grant agreement.
- Monitor the use of funds.
- Request reports, receipts, or other documentation.
- Provide a grant after appropriate review and approval.
Donations Made Through External Links
Some APANY website pages may include a link to an independent
organization’s website, fundraising page, payment processor,
crowdfunding campaign, or donation platform.
When a donor clicks an external link and completes a payment outside
APANY’s payment system:
- The donation is made directly to the identified third party.
- APANY does not receive or control the payment.
- APANY generally cannot issue a receipt, cancel the payment, or refund the transaction.
- The third party’s privacy, security, donation, and refund policies apply.
- The third party may charge processing or platform fees.
- Questions or disputes must be directed to that organization or payment provider.
Before paying: Verify the recipient displayed on the external payment page.
Tax-Deductibility of Third-Party Donations
APANY cannot guarantee that a donation made directly to an outside
organization is tax-deductible in the United States or any other
jurisdiction.
Tax treatment depends on:
- The legal status and location of the recipient.
- Whether it is eligible to receive deductible contributions.
- Whether goods or services are provided in return.
- Whether the payment is earmarked for a particular individual.
- The donor’s circumstances.
Direct contributions to many foreign organizations are not deductible
for United States federal income-tax purposes. The Internal Revenue
Service also generally does not allow deductions for gifts earmarked for a specific individual or family.
Donors should consult a qualified tax professional and independently
verify an organization’s status before claiming a deduction.
No Donation to a Named Individual
APANY does not permit its website or name to be used to solicit purported tax-deductible donations earmarked for a named individual or family unless the assistance is provided through an APANY-controlled charitable program using objective eligibility criteria.
A personal gift or direct crowdfunding payment may not qualify as a charitable contribution even when the recipient has a genuine need.
Partner Review
APANY may review prospective partners before listing, promoting, funding, or collaborating with them. A review reduces risk but does not guarantee an organization’s future conduct, performance, financial condition, or continued eligibility.
APANY may suspend or remove a partner listing or funding opportunity when concerns arise. Review considerations may include:
- Legal identity and registration
- Leadership and governance
- Mission and program alignment
- Financial and banking information
- Proposed use of funds
- Safeguarding practices
- Conflicts of interest
- Reputation and references
- Required licenses or approvals
- Reporting capacity
Partner Responsibilities
Partners are responsible for:
- Providing accurate information
- Using funds only for approved purposes
- Maintaining proper financial records
- Complying with applicable laws
- Protecting beneficiaries and personal information
- Disclosing conflicts of interest
- Reporting material problems promptly
- Providing requested reports and receipts
- Correcting outdated website information
A partner may not represent that APANY endorses, controls, guarantees, or fiscally sponsors the organization unless APANY has authorized that statement in writing.
Website Information and External Content
APANY attempts to keep partner information accurate, but outside
organizations control their own websites, forms, payment pages, and communications.
APANY is not responsible for:
- Changes made to an external website
- External website availability
- Third-party cybersecurity practices
- Malware or technical failures
- Third-party data collection
- Unauthorized fundraising pages
- Misrepresentations made by outside parties
- Transactions completed outside APANY’s systems
Donors should confirm that an external page is authentic and secure before entering personal or payment information.
Refunds and Disputes
For donations made directly to APANY, APANY’s Donation and Refund Policy applies.
For donations made directly to an outside organization or payment
platform, the donor must contact that organization or provider. APANY cannot promise, authorize, or process a refund of money it did not receive.
APANY may assist by providing available contact information, but it does not control the outcome of a third-party dispute.
Conflicts of Interest
APANY officers, directors, volunteers, and representatives must disclose personal, family, financial, or business interests involving a proposed partner or beneficiary.
Partnership and funding decisions must follow APANY’s conflict-of-interest and approval procedures. No APANY representative may promise funding, endorsement, tax treatment, or partnership status without proper authorization.
Reporting Concerns
Donors, beneficiaries, and community members may report concerns involving:
- Misuse of funds
- Misleading solicitations
- Unauthorized use of APANY’s name or logo
- Fraudulent payment pages
- Conflicts of interest
- Inaccurate partner information
- Safeguarding concerns
Reports will be reviewed in accordance with APANY’s governance procedures. Confidentiality cannot be guaranteed when disclosure is
required for investigation or by law.
